You may view this website on your computer screen and print its contents on your printer for your personal and non-commercial use only. In addition, where WT or REDBERRY so specify on the website, you may download material and save it to disc again for your personal and non-commercial use only. Without the written consent of WT or REDBERRY, you may not use, transfer, copy or reproduce any part of the content on the Site or its source HTML code in whole or in part, in any form or by any means, electronic, mechanical or otherwise, except for the sole purpose of viewing its contents. ”Working Title Films”, “WT²”, the Working Title and WT² logos and other products referenced on the site are either trademarks or registered trademarks of WT or its affiliated companies in the UK and/or other countries. Other products or company names referred to on the Site may be trademarks of their respective owners.

3. Use of E-cards

3.1 Description
WT and REDBERRY are providing users of the Site with a capability to send electronic mail via the World Wide Web and on REDBERRY’s own system (‘E-card facility’). You must: (1) provide all equipment, including a computer and modem necessary to establish a connection to the World Wide Web; and (2) provide for your own access to the World Wide Web and pay any telephone service fees associated with such access.

3.2 User Conduct
You are solely responsible for the contents of your transmissions through the E-card facility. Your use of the E-card facility is subject to all applicable European and UK national laws and regulations.

You agree not to:-
1. Use the E-card facility for chain letters, junk mail, spamming or any use of distribution lists to any person who has not given specific permission to be included in such a process.
2. Transmit through the E-card facility any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material of any kind or nature.
3. Use the E-card facility for illegal purposes.
You recognize and accept that the E-card facility provided by WT and REDBERRY is not intended to be an anonymous Email service. Every E-Card sent includes the IP (Internet Protocol) address from which the login session originated. With this header information, the source of a message can be narrowed dramatically (often directly to your computer). This is done for the protection of recipients of an E-card.

3.3 Privacy policy
WT and REDBERRY will not monitor, edit, or disclose the contents of your private communications unless required to do so by law or in the good faith belief that such action is necessary to: (1) conform to the edicts of the law or comply with legal process served on WT and/or REDBERRY; (2) protect and defend the rights or property of WT and/or REDBERRY; or (3) act under exigent circumstances to protect the personal safety of its users or the public.

You acknowledge and agree that WT and REDBERRY neither endorse the contents of any user communications nor assume responsibility for any threatening, libelous, obscene, harassing or offensive material contained therein, any infringement of third party intellectual property rights arising therefrom or any crime facilitated thereby.
You acknowledge and agree that certain technical processing of Email messages and their content may be required to: (1) send and receive messages; (2) conform to connecting networks' technical requirements; (3) conform to the limitations of the E-card facility; or (4) conform to other similar requirements.

WT and REDBERRY assume no responsibility for the deletion or failure to store E-card messages.

3.4 Indemnification
You agree to indemnify and hold WT and REDBERRY, their parents, subsidiaries, affiliates, officers and employees, harmless from any claim or demand, including attorneys' fees and costs, made by any third party due to or arising out of your use of the E-card facility.

4. Disclaimers

4.1 General

The Site is provided on an ‘as is’ basis. To the fullest extent possible at law, WT and REDBERRY hereby exclude any warranty, express or implied, as to the quality, accuracy, timeliness, completeness, performance or fitness for a particular purpose of the Site or any of its contents. Except as specifically stated on the Site, to the fullest extent permitted at law, WT and REDBERRY will not be liable for any direct, indirect, consequential or incidental damage or loss of any kind (including, without limitation, loss of profits, business interruption, loss of or corruption to business information or data, damage to business equipment or assets or economic loss of any other form), however caused, arising in contract, tort or otherwise from the use of or inability to use the Site, or any of contents of the Site or for any claim by a third party. For the avoidance of doubt, WT does not limit its liability for death or personal injury to the extent only that it arises as a result of the negligence of WT, its affiliates, directors, employees or other representatives.

WT makes no warranty that either the contents of the Site or the server that makes the Site available are free from infection by viruses or anything else which has contaminating or destructive properties.

5.1 General

To the extent that any data supplied by you (such as your name, Email address, gender, age or movie preferences) while using the Site are personal (as defined in any relevant data protection legislation), such personal data will only be used by WT and REDBERRY in accordance with European and UK national data protection laws for the time being in force. Your personal data will not be used in any other way without your consent.

5.2 Use of Personal Data

REDBERRY, acting as an agent for WT, will store any personal data provided by you for the following purposes:

to send out updates relating to WT’s activities, including but not limited to news, competitions, special offers and information on motion pictures and other productions WT is involved in, as described on the registration page; to identify users when they log in who have registered for the Working Title club; and to gain a better understanding of the profile of users of the Site. No personal data will be shared with third parties.
You may withdraw your consent to receive updates at any time by using the notification methods explained to you at the time of giving your consent and which will be posted on the Site.

6. Governing Law and general provisions

The Site and these terms and conditions will be governed by English Law. The English courts will have exclusive jurisdiction over any disputes arising in relation thereto. If any part of these terms and condition is found void and unenforceable, it will not affect the validity of the balance of these terms and conditions, which shall remain valid and enforceable.
